It is simply a fact that NO controlling legal authority has made a determination in these vital matters. If in the first instance Obama was never eligible under the Constitution to serve as president, then he sits in the Oval Office unlawfully and must be removed either by the Courts or by Congress. Further, if found ineligible, Obama has then never been a lawful president and full impeachment proceedings would cease to apply; he would thereby be compelled to resign or be removed from office as a usurper.
Unless Congress begins formal investigation proceedings NOW, Obama may never be properly vetted and determined to be Constitutionally qualified or not to hold office. He is actively and aggressively running for re-election – and the lawfulness of his first term could become a pale historical question against the Constitutional damage wrought by toleration of a second unlawful term.
As Gary Kreep of the U.S. Justice Foundation just argued before the federal Appellate Justices, "Nobody is willing to take on this issue…" even though "John McCain was the subject of Congressional deliberation and analysis on whether he was eligible – and a ruling was issued. Why McCain and not Obama?"

It is now clear the Obama Administration is actively working to overthrow the Constitutional protections granted by our Founding Fathers through the separation of powers. There can be no denying this Administration is in complete contempt of the U.S. Constitution, and in active defiance of the expressed Will of the People, and the Judicial and Congressional branches of the government – in effect replacing the Rule of Law with the seedbed of tyranny.
Cleon Skousen, in his book The 5,000 Year Leap, lays out a vivid explanation of the separation and balance of powers, illustrated with a three headed eagle.
Central head = the law-making or legislative function with two eyes – the House and the Senate – and these must both see reasonably eye-to-eye on any piece of legislation before it can become law.
Left head = the Administrative or Executive Department with all authority centered in a single strong President, operating within a clearly defined framework of limited power.
Right head = the Judiciary which was assigned the task of acting as an objective guardian of the Constitution and an interpreter of its principles as originally designed by the Founders.
Left Wing = the problem-solving wing attached to the Executive; sensitive to the perceived needs of the people, whose appointees devise elaborate plans to solve these problems.
Right wing = attached to the Congress; has the responsibility of conserving the nation's resources and the people's freedom. One function is to assess the proposed programs of the left wing to determine propriety, affordability and the effect upon freedom these proposals might have.
The genius, according to Skousen, of the American system is not only the separation of powers but the fact that all three branches operate through a central system. The Founders carefully integrated these three departments so that each was coordinated with the others and could not function independently: crafting "Coordination without Consolidation." Balance is essential, for if both wings fulfill their assigned duties the American eagle will fly straight and high. However, if either wing becomes overbearing or distorted, the American eagle of governance will drift toward anarchy or tyranny.

As Republicans contemplate their response to President Obama's coming nomination to the Supreme Court, we should go beyond the traditional scrutiny over social issues and demand that any nominee elaborate his or her views about the constitutionality of the recent legislation passed by this Administration. The hearings on his nominee will be an ideal opportunity to convince the public of the unconstitutionality of his power grabs.
The Obamacare bill, for example, not only strips states of the right to determine who will get Medicaid coverage within their borders, but it forces the states to pick up part of the tab. This is a violation of the very concept of the Tenth Amendment which provides that "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

With 10 states joining Florida in this proposed lawsuit, Alabama, Texas, South Carolina, Utah, Nebraska, Pennsylvania, Washington, North Dakota and South Dakota, the lawsuit will challenge if the passage of the bill is constitutional.
"The health care reform legislation passed by the U.S. House of Representatives last night clearly violates the U.S. Constitution and infringes on each state's sovereignty," McCollum said during a news conference.
The lawsuit will be filed once Obama signs ObamaCare into law. McCollum expects the lawsuit to end up in the Supreme Court's hands. Massachusetts is painfully aware of the destruction a healthcare insurance mandate does. It is the only state in the nation to currently require mandatory health insurance for its residents. The failed healthcare plan has all but bankrupted the state.

Reid Did It! Nazi "Eternity" Section in Health Bill Put in Secretly Behind Closed Doors
December 29, 2009 (LPAC)—The fascist secret clauses in the Senate health-care bill — attempting to forbid any future Congress from changing any of the provisions relating to the dictatorial, genocidal Independent Medicare Advisory Board — were inserted into the bill during closed-door meetings in Senate Majority Leader Harry Reid's office, not by an amendment duly considered by the Senate.
The subsection of the Senate bill which we reprint below, entitled "LIMITATION ON CHANGES TO THE BOARD RECOMMENDATIONS," was not in the Senate Finance Committee bill as approved by the committee on October 13, and printed on October 19 — even though the committee version contain much of the exact language surrounding this subsection which was incorporated into the final Senate bill. Nor was it in the House bill HR 3962. This subsection first appeared in the so-called "Substitute Amendment" filed in the Senate on November 19, after a month's worth of secret discussions and negotiations in Reid's office. Unlike proceedings in committees, or on the Senate floor, there is no record of what took place in Reid's office, although a number of accounts reported that the Obama White House was deeply involved in the secret negotiations.

The language in the Nov. 19 "Substitute Amendment" became part of the final bill passed by the entire Senate on the morning of December 24. This subsection is found on pages 1001-2 of the final bill, as printed by the GPO.
Following is the subsection of the final Senate health-care bill, subsection (d)(3), part of Section 3403, which attempts to prohibit any future changes to IMAB recommendations, or even to this subsection itself!
The impudent tyranny of Sen. Harry Reid... Senate Majority Leader Harry Reid of Nevada is proving once again the maxim that darkness hates the light. Buried in his massive amendment to the Senate version of Obamacare is Reid's anti-democratic poison pill designed to prevent any future Congress from repealing the central feature of this monstrous legislation!
Beginning on page 1,000 of the measure, Section 3403 reads in part: ". it shall not be in order in the Senate or the House of Representatives to consider any bill, resolution, amendment or conference report that would repeal or otherwise change this subsection."
In other words, if President Barack Obama signs this measure into law, no future Senate or House will be able to change a single word of Section 3403, regardless whether future Americans or their representatives in Congress wish otherwise!!
Note that the subsection at issue here concerns the regulatory power of the Independent Medicare Advisory Board (IMAB) to "reduce the per capita rate of growth in Medicare spending."
That is precisely the kind of open-ended grant of regulatory power that effectively establishes the IMAB as the ultimate arbiter of the cost, quality and quantity of health care to be made available to the American people. And Reid wants the decisions of this group of unelected federal bureaucrats to be untouchable for all time.
No wonder the majority leader tossed aside assurances that senators and the public would have at least 72 hours to study the text of the final Senate version of Obamacare before the critical vote on cloture. And no wonder Reid was so desperate to rush his amendment through the Senate, even scheduling the key tally on it at 1 a.m., while America slept.
True to form, Reid wanted to keep his Section 3403 poison pill secret for as long as possible, just as he negotiated his bribes for the votes of Senators Mary Landrieu of Louisiana, Ben Nelson of Nebraska and Bernie Sanders of Vermont behind closed doors.
The final Orwellian touch in this subversion of democratic procedure is found in the ruling of the Reid-controlled Senate Parliamentarian that the anti-repeal provision is not a change in Senate rules, but rather of Senate "procedures." Why is that significant?
Because for 200 years, changes in the Senate's standing rules have required approval by two-thirds of those voting, or 67 votes rather than the 60 Reid's amendment received.
Reid has flouted two centuries of standing Senate rules to pass a measure in the dead of night that no senator has read, and part of which can never be changed. If this is not tyranny, then what is?

Parker Griffith's decision to step out of line and refuse to drink the Democratic Kool-Aid illustrates the Achilles Heel of the Democratic regime in Washington: The radical reign of Pelosi and Reid is held up by pillars of moderate and conservative Democrats who come from districts that regularly vote Republican. To survive in these red precincts, Democrats must act like Republicans, advocating a balanced budget, opposing big spending, and fighting against socialized medicine.
But, in Washington, Pelosi and Reid use their backing to bring a radical left leadership to Congress. Once it sufficed for a moderate Democrat merely to vote "no."
But American voters are onto their tricks and realize that a Democrat -- any Democrat -- will vote "yes" when his party leaders need it. The unanimous Senate Democratic support for Obamacare shows that there are really only two types of Congresspeople: Democrats and Republicans. All other shadings and adjectives are mere decoration.
The Senate deal-making that produced party unity has gone on in full public view, a vindication of Otto Von Bismark's wisdom in proclaiming that the public should never witness either a sausage being made or a law being passed.
We are watching, real time, as moderate Democrats fold for tiny, dirty little payoffs to their states and their egos. A moderate Democrat is just someone who will demand a higher price for caving into what Reid and Pelosi and Obama want him to do.
By focusing on his so-called moderation and hoping for his support, we just drive up his market price and elevate the bribe he will get. (We only know now about the publicly funded bribes these moderate members of Congress are getting.
We will learn, as the years unfold, what private commitments were exchanged for their health care votes. Follow the judgeships, ambassadorships, and cabinet positions to see where these folks land after their voters have thrown them out.)
So Parker Griffith realized -- as others will -- that merely voting against the legislation he did not like would not be sufficient to inoculate him against voter anger. To get out of the way of the looming tsunami of 2010, he had actually to switch political parties and become a Republican.
In 2010, voters will realize that their can vote only for one of the two parties. Individuals don't matter. Candidate personalities, preferences, backgrounds, and even ideologies don't matter.
Once the smart voter said that he votes for the person, not the party. Now, this once virtuous citizen would be a fool. There is no such thing as a moderate Democrat or a centrist or a conservative or a Reagan Democrat.

So Parker Griffith realized -- as others will -- that merely voting against the legislation he did not like would not be sufficient to inoculate him against voter anger. To get out of the way of the looming tsunami of 2010, he had actually to switch political parties and become a Republican.In 2010, voters will realize that their can vote only for one of the two parties. Individuals don't matter. Candidate personalities, preferences, backgrounds, and even ideologies don't matter.
Once the smart voter said that he votes for the person, not the party. Now, this once virtuous citizen would be a fool. There is no such thing as a moderate Democrat or a centrist or a conservative or a Reagan Democrat.
There are only Democrats who, when the chips are down, will vote as his leaders need him to vote. Congressman Parker Griffith, the newly minted Republican, is typical of his class of freshmen Democrats from heavily McCain districts.

Due to pressure from enraged Americans, the most pernicious features of Obama's healthcare legislation have, for now at least, been stripped from his bill. This is no time for complacency, however, since the liberals are trying to push back and get the provisions back in.
As the bill now stands, it doesn't have any teeth.
* Without the public option, the government does not have the financial clout to enforce the decisions of the new secretary of Health about the protocols of care to be followed. The left had hoped that the federal public option insurance company would put the private firms out of business and leave a single governmental payer in place. This single payer could slice reimbursements to providers at will and bring them into line offering low costs, long waiting lists and rationed medical care. But with no expansion of Medicare to those over 55 and no federal public option, the secretary of Health won't have the power to force bad medical care down the throats of the American people.
* Relatively few new people will get health insurance. The costs of coverage are too high, the subsidies too shallow and the punitive fines too low to force people to buy policies they don't want and think they don't need. What young, childless couple is going to pay 8 to 12 percent of their income for Insurance rather than just pay the $1,000 fine for not having coverage? Oddly, this bill is really just a tax on the uninsured.
* Without the feared flood of new patients into the system, the rationing that threatened may not be as bad as it once seemed. With only a few newly insured people, the long waiting lists and shortages of medical personnel Massachusetts is experiencing under Romney-Care may not happen nationally.
* The Medicare cuts are to be proposed by a special commission in the executive branch akin to the federal commission that decides which military bases to shutter. But then they will have to be approved each year by Congress. A former secretary of Health and Human Services under a Republican president told me recently he expects the cuts will be vetoed by Congress each year and never really take effect. He says that the savings won't materialize and the additional costs of Obama's program will just be financed through even more deficit spending. He cites, for example, Congress's refusal for each of the past five years to approve the automatic 6 percent cut in physicians' fees.
What's left is a bill that expands Medicaid to cover more of the poor and working poor. It requires that all states cover everyone making 150 percent or less of the poverty level. This will end the practice of many states of restricting Medicaid, in effect, to the elderly in nursing homes.
Arkansas, for example, only covers up to 17 percent of the poverty level (about $4,000 of income). Under the new law, anyone in the state whose income is less than about $27,000 will have to be covered. This provision will, of course, mean much higher state taxes throughout the South and in Texas, California, Pennsylvania and Florida, states with low Medicaid thresholds.
The rest of the bill is essentially a consumer-protection statute that bars insurers from denying coverage to anyone and stops them from charging more for those who are sick. Both the expansion of Medicaid and this reform of insurance-company practices could have been achieved in considerably less than the 2,000 pages of dead trees this bill consumed.
There are still bad parts of the legislation:
* Medicare Advantage, an important program for 10 million elderly, will be gutted and replaced by Medigap insurance, which is more limited in coverage, higher in cost and more profitable to the AARP.
* Medical devices -- from pacemakers to automated wheelchairs -- will still be taxed, and sick people will be forced to pay higher taxes and deduct fewer of their medical costs.
* Reimbursements under Medicare are likely to continue to drop, forcing more and more providers to refuse to treat patients under the program.
Obama is left with the symbol of a victory but not much substance. He will still sign the bill -- if it ever passes -- with great fanfare, but its substance will be painfully thin.
We haven't dodged the bullet yet. The left is still to be heard from. But the momentum against the bill and the focus on its worst provisions is paying off. Keep up the pressure!

Reid's Senate version of ObamaCare calls for:
Hiding the $2.8 Trillion price tag by not accounting for actual costs.
Major reductions in Medicare befits to seniors.
Major Tax Increases on every American to pay for it all.
Reid called for increasing the Medicare payroll tax.
The Senate ObamaCare creates a new marriage penalty by imposing a tax on individuals who make $200,000 annually but hitting married couples making just $50,000 more.
That's one of 17 new taxes imposed by the bill, which also creates a levy on elective plastic surgery - some call it "BOTAX" - and places a 40 percent excise tax on those who have generous health care plans.
"If you have insurance, you get taxed. If you don't have insurance, you get taxed. If you need a life-saving medical device, you get taxed. If you need prescription medicines, you get taxed," said Senate Minority Leader Mitch McConnell, Kentucky Republican, who is leading the fight against the bill.
Those legislators will be feeling the WRATH of voters next year -- but WE still have our work cut out for us NOW!
And we CAN defeat it there!
In fact... we can stop this bill COLD. Here's how:
Senate Majority Leader Harry Reid (D-NV) must now set the date for the next cloture vote to end all debate over Republican objection and the bill would be pushed onto the Senate calendar for a final vote.
BUT... Reid's sneak attack sets up the next critical cloture vote likely next week to PASS THE SENATE OBAMACARE BILL. This will require 60 votes to succeed -- and there's a GOOD CHANCE that Reid does NOT have those 60 votes!
If Republicans filibuster this motion, he will need 60 votes to invoke cloture and shut off debate.
If cloture fails the bill will die!
THIS IS IT -- one of our BEST chances to kill this bill, before it even gets off the ground!
WE HAVE NOT LOST. The bill pushed by Obama, passed by leftist Democrats in the House -- and rejected unanimously by all Senate Republicans -- must now be debated in the U.S. Senate...

Obama Failure and Socialism ObamaCare HealthCare Bill
Here is what you need to know. All 1,990 pages condensed to these points:
The health bill that House Speaker Nancy Pelosi is bringing to a vote (H.R. 3962) is 1,990 pages. Here are some of the details you need to know.
What the government will require you to do:
· Sec. 202 (p. 91-92) of the bill requires you to enroll in a "qualified plan." If you get your insurance at work, your employer will have a "grace period" to switch you to a "qualified plan," meaning a plan designed by the Secretary of Health and Human Services. If you buy your own insurance, there's no grace period. You'll have to enroll in a qualified plan as soon as any term in your contract changes, such as the co-pay, deductible or benefit.
· Sec. 224 (p. 118) provides that 18 months after the bill becomes law, the Secretary of Health and Human Services will decide what a "qualified plan" covers and how much you'll be legally required to pay for it. That's like a banker telling you to sign the loan agreement now, then filling in the interest rate and repayment terms 18 months later.
On Nov. 2, the Congressional Budget Office estimated what the plans will likely cost. An individual earning $44,000 before taxes who purchases his own insurance will have to pay a $5,300 premium and an estimated $2,000 in out-of-pocket expenses, for a total of $7,300 a year, which is 17% of his pre-tax income. A family earning $102,100 a year before taxes will have to pay a $15,000 premium plus an estimated $5,300 out-of-pocket, for a $20,300 total, or 20% of its pre-tax income. Individuals and families earning less than these amounts will be eligible for subsidies paid directly to their insurer.
· Sec. 303 (pp. 167-168) makes it clear that, although the "qualified plan" is not yet designed, it will be of the "one size fits all" variety. The bill claims to offer choice-basic, enhanced and premium levels-but the benefits are the same. Only the co-pays and deductibles differ. You will have to enroll in the same plan, whether the government is paying for it or you and your employer are footing the bill.
· Sec. 59b (pp. 297-299) says that when you file your taxes, you must include proof that you are in a qualified plan. If not, you will be fined thousands of dollars. Illegal immigrants are exempt from this requirement.
· Sec. 412 (p. 272) says that employers must provide a "qualified plan" for their employees and pay 72.5% of the cost, and a smaller share of family coverage, or incur an 8% payroll tax. Small businesses, with payrolls from $500,000 to $750,000, are fined less.
Eviscerating Medicare:
In addition to reducing future Medicare funding by an estimated $500 billion, the bill fundamentally changes how Medicare pays doctors and hospitals, permitting the government to dictate treatment decisions.
· Sec. 1302 (pp. 672-692) moves Medicare from a fee-for-service payment system, in which patients choose which doctors to see and doctors are paid for each service they provide, toward what's called a "medical home."
The medical home is this decade's version of HMO-restrictions on care. A primary-care provider manages access to costly specialists and diagnostic tests for a flat monthly fee. The bill specifies that patients may have to settle for a nurse practitioner rather than a physician as the primary-care provider. Medical homes begin with demonstration projects, but the HHS secretary is authorized to "disseminate this approach rapidly on a national basis."
A December 2008 Congressional Budget Office report noted that "medical homes" were likely to resemble the unpopular gatekeepers of 20 years ago if cost control was a priority.
· Sec. 1114 (pp. 391-393) replaces physicians with physician assistants in overseeing care for hospice patients.
· Secs. 1158-1160 (pp. 499-520) initiates programs to reduce payments for patient care to what it costs in the lowest cost regions of the country. This will reduce payments for care (and by implication the standard of care) for hospital patients in higher cost areas such as New York and Florida.
· Sec. 1161 (pp. 520-545) cuts payments to Medicare Advantage plans (used by 20% of seniors). Advantage plans have warned this will result in reductions in optional benefits such as vision and dental care.
· Sec. 1402 (p. 756) says that the results of comparative effectiveness research conducted by the government will be delivered to doctors electronically to guide their use of "medical items and services."
Questionable Priorities:
While the bill will slash Medicare funding, it will also direct billions of dollars to numerous inner-city social work and diversity programs with vague standards of accountability.
· Sec. 399V (p. 1422) provides for grants to community "entities" with no required qualifications except having "documented community activity and experience with community healthcare workers" to "educate, guide, and provide experiential learning opportunities" aimed at drug abuse, poor nutrition, smoking and obesity. "Each community health worker program receiving funds under the grant will provide services in the cultural context most appropriate for the individual served by the program."
These programs will "enhance the capacity of individuals to utilize health services and health related social services under Federal, State and local programs by assisting individuals in establishing eligibility . . . and in receiving services and other benefits" including transportation and translation services.
· Sec. 222 (p. 617) provides reimbursement for culturally and linguistically appropriate services. This program will train health-care workers to inform Medicare beneficiaries of their "right" to have an interpreter at all times and with no co-pays for language services.
· Secs. 2521 and 2533 (pp. 1379 and 1437) establishes racial and ethnic preferences in awarding grants for training nurses and creating secondary-school health science programs. For example, grants for nursing schools should "give preference to programs that provide for improving the diversity of new nurse graduates to reflect changes in the demographics of the patient population." And secondary-school grants should go to schools "graduating students from disadvantaged backgrounds including racial and ethnic minorities."
· Sec. 305 (p. 189) Provides for automatic Medicaid enrollment of newborns who do not otherwise have insurance.

Individuals and families earning less than these amounts will be eligible for subsidies paid directly to their insurer.
· Sec. 303 (pp. 167-168) makes it clear that, although the "qualified plan" is not yet designed, it will be of the "one size fits all" variety. The bill claims to offer choice-basic, enhanced and premium levels-but the benefits are the same. Only the co-pays and deductibles differ. You will have to enroll in the same plan, whether the government is paying for it or you and your employer are footing the bill.
· Sec. 59b (pp. 297-299) says that when you file your taxes, you must include proof that you are in a qualified plan. If not, you will be fined thousands of dollars. Illegal immigrants are exempt from this requirement.
· Sec. 412 (p. 272) says that employers must provide a "qualified plan" for their employees and pay 72.5% of the cost, and a smaller share of family coverage, or incur an 8% payroll tax. Small businesses, with payrolls from $500,000 to $750,000, are fined less.
Eviscerating Medicare:
In addition to reducing future Medicare funding by an estimated $500 billion, the bill fundamentally changes how Medicare pays doctors and hospitals, permitting the government to dictate treatment decisions.
· Sec. 1302 (pp. 672-692) moves Medicare from a fee-for-service payment system, in which patients choose which doctors to see and doctors are paid for each service they provide, toward what's called a "medical home."
The medical home is this decade's version of HMO-restrictions on care. A primary-care provider manages access to costly specialists and diagnostic tests for a flat monthly fee. The bill specifies that patients may have to settle for a nurse practitioner rather than a physician as the primary-care provider. Medical homes begin with demonstration projects, but the HHS secretary is authorized to "disseminate this approach rapidly on a national basis."
A December 2008 Congressional Budget Office report noted that "medical homes" were likely to resemble the unpopular gatekeepers of 20 years ago if cost control was a priority.
· Sec. 1114 (pp. 391-393) replaces physicians with physician assistants in overseeing care for hospice patients.
· Secs. 1158-1160 (pp. 499-520) initiates programs to reduce payments for patient care to what it costs in the lowest cost regions of the country. This will reduce payments for care (and by implication the standard of care) for hospital patients in higher cost areas such as New York and Florida.
· Sec. 1161 (pp. 520-545) cuts payments to Medicare Advantage plans (used by 20% of seniors). Advantage plans have warned this will result in reductions in optional benefits such as vision and dental care.
· Sec. 1402 (p. 756) says that the results of comparative effectiveness research conducted by the government will be delivered to doctors electronically to guide their use of "medical items and services."
Questionable Priorities:
While the bill will slash Medicare funding, it will also direct billions of dollars to numerous inner-city social work and diversity programs with vague standards of accountability.
· Sec. 399V (p. 1422) provides for grants to community "entities" with no required qualifications except having "documented community activity and experience with community healthcare workers" to "educate, guide, and provide experiential learning opportunities" aimed at drug abuse, poor nutrition, smoking and obesity. "Each community health worker program receiving funds under the grant will provide services in the cultural context most appropriate for the individual served by the program."
These programs will "enhance the capacity of individuals to utilize health services and health related social services under Federal, State and local programs by assisting individuals in establishing eligibility . . . and in receiving services and other benefits" including transportation and translation services.
· Sec. 222 (p. 617) provides reimbursement for culturally and linguistically appropriate services. This program will train health-care workers to inform Medicare beneficiaries of their "right" to have an interpreter at all times and with no co-pays for language services.
· Secs. 2521 and 2533 (pp. 1379 and 1437) establishes racial and ethnic preferences in awarding grants for training nurses and creating secondary-school health science programs. For example, grants for nursing schools should "give preference to programs that provide for improving the diversity of new nurse graduates to reflect changes in the demographics of the patient population." And secondary-school grants should go to schools "graduating students from disadvantaged backgrounds including racial and ethnic minorities."
· Sec. 305 (p. 189) Provides for automatic Medicaid enrollment of newborns who do not otherwise have insurance.

“Voters under 30 are the strongest supporters of Obama’s plan,” said Bob Adams, executive director of the League of American Voters. “Until they learn Obama imposes heavy fines on them, not to mention taxes on wheelchairs, pacemakers, and even breast-milk pumps for working mothers — all to pay for his expensive plan. And that’s just the tip of the dirty needle.”
The under-30 age group gave Barack Obama 66 percent of their vote in the 2008 presidential election, and are the last remaining age demographic group still onboard with the president’s plan.
Seniors originally backed Obamacare, but the League and others launched a national campaign exposing its dangers to the elderly. Almost every national poll today shows seniors strongly oppose Obamacare.
"We believe young voters will wake up to the dangerous reality of Obamacare, just like seniors did," Adams explained.
The League has strong evidence its outreach to young people will work.
A recent League survey found a collapse in support among young voters when they learned the details of the plan.
Under-30 voters backed “the healthcare bill making its way through Congress and supported by President Obama” by a margin of 58 percent to 30 percent, according to the survey.
But when the same groups of voters were provided a fair and unbiased description of the plan, support dropped 13 points to a margin of 55 percent to 40 percent When told specific details of the plan — such as taxes for medical devices, unrealistic cost estimates, rationing for the elderly, and cuts to Medicare — under-30 voters opposed by a margin of 43 percent to 45 percent — a nosedive of 30 points.
To complement its Web strategy, the League is also running a series of TV spots targeted at under-30 voters in keys swings states.
The first ad began airing in four states and is a take-off of the famous Mac commercial. The ad also runs on GenHope.com.
“This is ‘reality-based’ politics, not the ‘make-believe’ fantasy world painted by the White House,” Adams said. “The ‘game’ is over when young people learn just how devastating Obamacare will be for their future and families.”

BUT... Reid's action last Tuesday sets up a critical vote this week on a motion to proceed to the bill. Such a motion would require 60 votes to succeed -- and there's a GOOD CHANCE that Reid does NOT have those 60 votes!
Reid needs a majority (51) to pass the motion to proceed so the Senate can begin debating and amending the bill. If Republicans filibuster this motion, he will need 60 votes to invoke cloture and shut off debate.

The CBO estimates that H.R. 3962, the health bill that the House passed, would cost $1.2 TRILLION over 10 years, including the cost to states for mandated Medicaid expansion ($34 billion), the "Doc Fix" ($245 billion), and authorized discretionary spending for grants, public programs, changes and funding for a variety of agencies that would be responsible for implementing H.R. 3962.
The bill protects trial lawyers. The bill gives money (authorized at "such sums") to states that enact "certificate of merit" (a document signed by a medical professional that says there is a probability that the standard of care was violated) and / or a certificate of "early offer" (an early, confidential apology) laws, as long as the states don't limit attorneys' fees or impose caps on damages.
The current version will give billions of dollars of taxpayer healthcare benefits to ILLEGAL ALIENS in America. It would allow illegal aliens to use the new healthcare "exchange" and would not require verification to keep illegal aliens out of the other parts of the proposed federal healthcare system.
Members of the Congressional Hispanic Caucus fought back against reports that leaders would add Senate language to block illegal immigrants from participating in the insurance exchange. It will create a nationwide federal government program, the "public option," which will pay for abortion on demand -- with federal funds, of course, because that is what federal agencies spend. A Zogby Poll this week illustrates the stark choice facing Senate Democrats as they have to decide whether or not to vote for ObamaCare. The poll shows that Arkansas Sen. Blanche Lincoln, high up on the list of vulnerable Senate Democrats seeking reelection in 2010, literally faces a choice between being reelected and voting for the bill.
The Zogby Poll shows Arkansans opposed to the Obama/Reid bill by 28-64, with 50 percent "strongly opposed" to the legislation. To swim in the face of such a current of public opinion is risky business for a U.S. senator.
Lincoln's most likely Republican opponent, state Sen. Gilbert Bennett, is hot on her heels in the poll, trailing by only 41-39. Most Arkansans don't know how Lincoln will vote. Forty-two percent predicted that she would back the bill, but 24 percent said she was more likely to oppose it. Thirty-six percent did not know.
Her fellow Arkansas senator, Mark Pryor (D), is also in play on this legislation. Thirty-five percent of his voters think he will vote yes, while 18 percent think he will vote no and 47 percent don't know.
While Pryor is not up for reelection this year, he is also almost certainly signing his political death warrant if he votes for the bill.
This survey, taken by Zogby, was funded by the League of American Voters as part of its efforts to influence swing senators and defeat the healthcare legislation. The League has been running ads in Arkansas aimed at explaining the costs of the bill both for the old and the young. The polling shows that the ads are working.
The League has run ads in Indiana, North Dakota, Nebraska, Louisiana, North Carolina, Virginia, Maine, Montana, Colorado, Florida and Connecticut to push swing senators to oppose the bill. It will retain Zogby to do surveys in many of these states to bring home to their senators how strongly those they represent do not want this bill to pass.

As part of the League's work against the bill, Dick went to Arkansas on Thursday, November 19th to tour the state and to publicize the findings of the Zogby Poll. In three press conferences (in Little Rock, Conway, and Hot Springs), Dick warned Senator Lincoln about how strongly her constituents feel about the bill. The recent decision of the federal government to recommend that women abstain from annual mammograms illustrates well, exactly how Obamacare would force a deterioration in the quality of medical care, particularly for the elderly. The panel evaluating the effectiveness of mammograms did not find that they don't work or that they do not save lives. Rather, it found that the lives they save are not "worth" the cost of annual testing. This bureaucratic balancing of human life and financial cost lies at the core of the government managed health care in the Obama Bill. To maximize your chances of avoiding breast cancer, women over 50 should, of course, be tested annually. But to save the government money and to conserve scarce resources, the government would like them to increase their chances of becoming sick and get screened only every other year.
Under our current health care system, the government can only recommend such changes.
But under Obamacare, it can and will require them. This rationing of health care, of course, primarily effects the elderly since it is they who need care the most. Who could ask for a better illustration of how this system would work than the government's sudden discovery that saving lives through mammograms is not worth the cost?

A Zogby Poll this week illustrates the stark choice facing Senate Democrats as they have to decide whether or not to vote for ObamaCare. The poll shows that Arkansas Sen. Blanche Lincoln, high up on the list of vulnerable Senate Democrats seeking reelection in 2010, literally faces a choice between being reelected and voting for the bill.
The Zogby Poll shows Arkansans opposed to the Obama/Reid bill by 28-64, with 50 percent "strongly opposed" to the legislation. To swim in the face of such a current of public opinion is risky business for a U.S. senator.
Lincoln's most likely Republican opponent, state Sen. Gilbert Bennett, is hot on her heels in the poll, trailing by only 41-39. But asked who they would support if Lincoln votes for ObamaCare, Arkansas voters switch to Bennett, giving him a 49-36 victory. A Doctor's Plan for Legal Industry Reform
My modest proposal to rearrange how lawyers do business.

Since we are moving toward socialism with ObamaCare, the time has come to do the same with other professions—especially lawyers. Physician committees can decide whether lawyers are necessary in any given situation.
At a town-hall meeting in Portsmouth, N.H., last month, our uninformed lawyer in chief suggested that we physicians would rather chop off a foot than manage diabetes since we would make more money doing surgery. Then President Obama compounded his attack by claiming a doctor's reimbursement is between "$30,000" and "$50,000" for such amputations! (Actually, such surgery costs only about $1,500.)
Physicians have never been so insulted. Because of these affronts, I will gladly volunteer for the important duty of controlling and regulating lawyers. Since most of what lawyers do is repetitive boilerplate or pushing paper, physicians would have no problem dictating what is appropriate for attorneys. We physicians know much more about legal practice than lawyers do about medicine.
Following are highlights of a proposed bill authorizing the dismantling of the current framework of law practice and instituting socialized legal care:
• Contingency fees will be discouraged, and eventually outlawed, over a five-year period. This will put legal rewards back into the pockets of the deserving—the public and the aggrieved parties. Slick lawyers taking their "cut" smacks of a bookie operation. Attorneys will be permitted to keep up to 3% in contingency cases, the remainder going into a pool for poor people.
• Legal "DRGs." Each potential legal situation will be assigned a relative value, and charges limited to this amount. Program participation and accep tance of this amount is mandatory, regardless of the number of hours spent on the matter. Government schedules of flat fees for each service, analogous to medicine's Diagnosis Related Groups (DRGs), will be issued. For example, any divorce will have a set fee of, say, $1,000, regardless of its simplicity or complexity. This will eliminate shady hourly billing. Niggling fees such as $2 per page photocopied or faxed would disappear. Who else nickels-and-dimes you while at the same time charging hundreds of dollars per hour? I'm surprised lawyers don't tack shipping and handling onto their bills.
• Legal "death panels." Over 75? You will not be entitled to legal care for any matter. Why waste money on those who are only going to die soon? We can decrease utilization, save money and unclog the courts simultaneously. Grandma, you're on your own.
• Ration legal care. One may need to wait months to consult an attorney. Despite a perceived legal need, physician review panels or government bureaucrats may deem advi ce unnecessary. Possibly one may not get representation before court dates or deadlines. But that' s tough: What do you want for "free"?
• Physician controlled legal review. This is potentially the most exciting reform, with doctors leading committees for determining the necessity of all legal procedures and the fairness of attorney fees. What a wonderful way for doctors to get even with the sharks attempting to eviscerate the practice of medicine.
• Discourage/eliminate specialization. Legal specialists with extra training and experience charge more money, contributing to increased costs of legal care, making it unaffordable for many. This reform will guarantee a selection of mediocre, unmotivated attorneys but should help slow rising legal costs. Big shot under indictment? Classified National Archives documents down your pants? Sitting president defending against impeachment? Have FBI agents found $90,000 in your freezer? Too bad. Under reform you too may have to go to the government legal shop for advice.
• Electronic legal records. We should enter the digital age and computerize and centralize legal records nationwide. All files must be in a standard, preferably inconvenient, format and must be available to government agencies. A single database of judgments, court records, client files, etc. will decrease legal expenses. Anyone with Internet access will be able to search the database, eliminating unjustifiable fees charged by law firms for supposedly proprietary information, while fostering transparency. It will enable consumers to dump their clunker attorneys and transfer records easily.
• Ban legal advertisements. Catchy phone numbers such as 1-800-LAWYERS would be seized by the government and repurposed for reporting unscrupulous attorneys.
• New government oversight. Government overhead to=2 0manage the legal system will include a cabinet secretary, commissioners, ombudsmen, auditors, assistants, czars and departments.
• Collect data about the supply of and demand for attorneys.Create a commission to study the diversity and geographic distribution of attorneys, with power to stipulate and enforce corrective actions to right imbalances. The more bureaucracy the better. One can never have too many eyes watching these sleazy sneaks.
• Lawyer Reduction Act (H.R. -3200). A self-explanatory bill that not only decreases the number of law students, but also arbitrarily removes 3,200 attorneys from practice each year. Textbook addition by subtraction.
Enthusiastically embracing the above legal changes can serve as a "teachable moment" and will go a long way toward giving the lawyers who run Congress a taste of their own medicine.

Now Obama is pushing for a radical takeover of one-sixth of the U.S. economy.
But Obama is perhaps the most clever liberal ever.
He knows the American people would never go for a national system like they have in Britain or Canada.
So his plan calls for several steps for Obamacare to become a reality.
